A Franklin County man, representing himself as a Child Protective Services worker, has been charged with three-counts of Impersonating a Public Servant, as well as sexual assault, in Lamar and Hopkins counties.
Lamar County Detectives were told that the suspect, later identified at 56-year old Gerald Don Miller, said he needed to speak with her child and gained access to the child.
The guardians of the victim and the victim gave a good description of the suspect and vehicle information.
During the investigation, detectives learned that the same incident occurred in Sulphur Springs, Texas, in November of 2023 and their suspect and vehicle description matched the suspect in Lamar County.
On June 25, 2024, detectives gained information on the suspect and positively identified the suspect as Miller.
An arrest warrant was obtained for Miller and a search warrant for Miller’s home and vehicle were executed in Franklin County.
During the execution of the search warrant, detectives recovered property from Miller’s vehicle corroborating what the victim in Lamar County described.
There was also evidence found in Miller’s vehicle linking him to the offense in Sulphur Springs.
Miller was taken in to custody at his residence in Franklin County and charged with the following:
Lamar County Sheriff’s Office: Impersonating a public servant – Miller bonded from Franklin County Jail on $25,000 bond and Sexual assault – Currently held in Hopkins County jail on $100,000 bond
Hopkins County Sheriff’s Office: Impersonating a public servant – being held in Hopkins County jail on $100,000 bond
Sulphur Springs Police Department: Impersonating a public servant – being held in Hopkins County jail on $100,000 bond
“It appears from the investigation, that Miller chose his victims, that were in the custody of grandparents and he did not have possession of, or show accredited credentials when contact was made,” said LCSO Captain Johnathan Smith.
Lamar County Sheriff’s Office commends the efforts and collaboration of the detectives working this case, Child Protective Services, the Sulphur Springs Police Department, Franklin County Sheriff’s Office and the Hopkins County Sheriff’s Office.
Law Enforcement and Child Protective Services want to remind communities, that if they are ever involved with CPS, the CPS workers will carry accredited credentials and their workers will show proof of their accredited credentials before talking to you.
Law Enforcement Agencies are asking if anyone has had any or recent contact with this subject, where he was alleging to be with CPS and did not show accredited credentials to please come forward by contacting your local law enforcement agency. Miller is 508, approximately 240 pounds, brown and white hair, with a white moustache and would have possibly carrying a red case with a Texas Department of Criminal Justice logo on it.
The investigation is ongoing.
